An out-of-control trader, whether rookie or seasoned veteran, will crash and burn quickly. A trader in control of his emotions has the game nearly won at the start.

We’ve all jumped into trades too soon, afraid that the market was going to run away without us. And we’ve all jumped out too soon, whether second-guessing the entry and not waiting for the trade to develop or snatching the quick profit instead of letting the trade play out and hit our target. The SIPC is non-profit organization funded by its member securities brokers, created by congress in 1970 to promote confidence in the US securities markets. The coverage is event-neutral in the sense that it replaces missing securities and cash whether they disappeared in an earthquake, fire,flood, or were stolen by a broker. Missing securities are replaced at their current market value which may be a fractionof their previous value.

To meet its obligations, SIPC currently has $1.25 billion of capital which invested in US Treasuries as required by law. It also has a $1.0 billion private syndicated line of credit to draw on should its capital be exhausted. On top of that, it has $1.0 billion in line of credit from the US Treasury.

To cover losses beyond that, brokererage firms have arrangements with the following insurers:

1. CAPCO (Customer Asset Protection Co.), which is a insurer of 14 brokerages, claims that it has no dollar limit on excess SIPC coverage; yet, if you desire to specifically inquire what the financial backing is for each customer coverage, president Frank Lagerstedt labels such information as “proprietary.” Lagersterdt has legal backing for withholding the information. The New York State Insurance Dept has repeatedly denied my Freedom of Information Act (FOIA) request for CAPCO’s financial information.

Also, CAPCO won’t disclose whether memeber firms are required to ante up addtional capital if a large claim drains its resourses. Moreover, none of the company’s officers explain how its “risk remote” potential liabilities are quantified. It is strongly believed that CAPCO is unable to quantify the risk for the same reasons the commercial insurers couldn’t. For that matter, the company is most likely undercapitalized.

Member firms belonging to CAPCO are: Robert W. Baird, Bear Stearns, Credit Suisse First Boston, A.G. Edwards, Goldman Sachs, Edward Jones, Legg Mason Wood Walker, Lehman Brothers, J.P. Morgan Chase, Morgan Stanley, National Financial Services, Pershing, Raymand James Financial, and Watchovia Securities.

2. Lloyd’s of London offers $150 million per customer but no more than a total of $600 million per broker-dealer for customer losses. Its client firms are Ameritrade, E*Trade, Merrill Lynch, Charles Schwab, Smith Barney, Citigroup, T.D. Waterhouse.

3. XL Insurance insures for up to $600 million in total customer losses. Its member firm is UBS Financial Services.

If brokerages are going to use excess SIPC coverage for their customers, don’t they owe an explanation of how they intend to provide it? It is highly suggested that excess SIPC coverage is little more than a marketing tool for brokerages that say they offer it. Most brokers claim that they purchase insurance for the sleep-at-night factor, and that excess SIPC has always been a nice enhancement for clients.

It is my personal adamant belief that rather than considering the amount of excess SIPC coverage a firm carries, an investor should place more emphasis on its financial strength.

Transform Your Debt With A 1031 Tax Exchange

Although 1031 Exchanges are primarily used to shift our equity from one property to another, there are ways of recovering some of that equity for use as leisure or further investment purposes. There are two ways to recover money from your property – before or after the 1031 Exchange is completed.

In a 1031 exchange, all the proceeds from the sale are supposed to be passed on to the Qualified Intermediary – this prevents you from receiving any cash benefit from the sale. There may be times, however, when you would like to use some of that money for other purposes. If you decide to refinance your property shortly before the 1031 exchange and use that equity for your desired luxury item, you may find yourself violating IRS rules. (IRS vs. Garcia)

Garcia was a taxpayer who decided to refinance his property in anticipation of the 1031 exchange. The IRS successfully argued that when Garcia took out money before the 1031, it was akin to telling the settlement agent to pay him some of the sale proceeds at closing. In short, you cannot take out your equity just before the 1031 exchange. Cashing out equity, called “boot,” is acceptable if you pay taxes on it. Garcia tried to avoid the tax and ran afoul of the 1031 rationale, and the IRS.

Now, you want to avoid the Garcia issue so you decide to refinance the replacement property. This is where post-exchange financing comes into play. Not all taxpayers want to leave their equity in the replacement property – some want to take out that equity and buy more real estate. But, how long should you wait after completing the 1031 exchange before you take out the equity in the replacement property? Some say wait a nanosecond.

There is debate on how long one must wait after the 1031 exchange to show the IRS, through the closing statement, that you have invested all of your equity into the replacement property. Some say wait a nanosecond to establish a separate transaction and a new settlement statement to show that the replacement property was encumbered with new debt via a loan or a mortgage. Once this is established, there is a cash payment from the lender to you. Essentially, you have tapped into a pool of money made available through the 1031 exchange.

There are risks in the nanosecond interpretation since there is no definitive IRS rule regarding how long you have to keep the equity in the replacement property. In order to avoid the Garcia trap, or a negative ruling from the IRS, it is deemed prudent to keep the equity in the replacement property until the following tax year, or until two years have passed from the 1031 exchange to the ultimate refinance.

While we’ll discuss preferred stock and penny stock later, the most commonly traded stock is in fact the common stock. Common stock is issued far more than any other kind of stock. When most people talk stocks, they’re talking common stocks. Common stocks provide the ability to own share in a corporation as well as to share in the corporation’s profits through dividends.

If you’re looking for the biggest long haul payout, common stocks are the way to go. But note that they’re also the most risky of investments. Consider that when a corporation has to go bankrupt and must liquidate, preferred shareholders, bondholders and creditors are paid out long before common stockholders.

Another kind of stock is preferred stock. This kind of stock provides a kind of ownership of the corporation not present in common stock. But in most cases it does not feature the same voting rights. Preferred shareholders, however, have the benefit of guaranteed fixed dividends.

Fixed dividends are a very potent benefit over common stock because those common stocks have varying dividends, never guaranteed. Preferred stockholders are also paid out before common stockholders during bankruptcy and liquidation. Preferred stocks also provide the benefit, in most cases, of being callable. When a stock is callable, a corporation can buy that stock at any time, most commonly at a premium price.

It is worth noting that many individuals view preferred stock as debt rather than equity. One might categorize them as something between a common share and a bond.

Within these two types of stock shares, you may also find different classes created by each corporation for specific operational purposes. This creates leverage for the corporation to better manage voting rights, thus giving greater end control to a predefined class of stocks than to the other class of stock shares.

Regardless of whether it is a common stock or a preferred stock, an additional class of stock delineation will determine the voting right of that stock. Some stocks will simply have a greater number of votes on corporate policy with each owned share than other classes of the same stock.

While common stock and preferred stock are the two main kinds of stocks, you also have another category altogether: the penny stock. You will see this described as either a penny stock or a micro cap stock. Some people don’t seem to realize this, but the term micro cap stock refers to a company’s market capitalization while the term penny stock refers to the actual stock price.

It can be confusing to read about penny stocks online. Partially because most people don’t really know what they’re talking about, but also because you see the terms micro cap stock and penny stocks used identically. In fact, the term micro cap stock refers to a stock with market capitalization in the 50 to 250 million dollar range while a penny stock is any stock under 5 bucks. And there is one final way to distinguish a penny stock: it is usually traded via the Pink Sheet or the OTCBB rather than NYSE or NASDAQ.

What you must consider most when evaluating a penny stock is how it will be far more volatile and susceptible to market manipulation and stock fraud.

The Important Steps of Day Trading Forex

Before I talk about how to succeed with day trading forex, I must let you know that many forex traders will lose money. It happens to us all.

If reading that didn’t scare you, then you might be one of the few people who have the courage to day trade the forex market carefully, and not fall into the dangers of overconfidence which many traders suffer from.

But even beyond that, the problem that many day traders have is that they just don’t understand the market.

That’s why you see so many of these day traders inundate their chart with useless indicators that provide absolutely no insight to the market such as stochastics, MACD, RSI, and other bells and whistles that may look pretty on the charts, but don’t amount to a hill of beans.

Since these indicators are completely lagging, you really get no insight as to what the future of the market holds.

One thing that most people don’t get is that all the answers are underneath those indicators, which is on a naked chart (meaning no indicators). The first you do this may seem awkward, but a bar chart is really the truest way to trade.

If you really study price action the right way, one thing will become very evident to you, and that is future price movement can, in fact be predicted. The opportunities are endless for a hard nose forex day trader. You’ll see so many entries, you won’t know which way to choose.

It’s just so difficult to see this when you have staring back at you, are these indicators that are of no help. If you want to learn day trading, you better learn price action. They are synonymous with each other.
